SpaceX, the brainchild of Elon Musk, has found itself in hot water due to repeated violations of environmental regulations in Texas. The Texas Commission on Environmental Quality (TCEQ) issued a notice of violation against SpaceX for releasing pollutants into or near bodies of water at its Starbase launch facility in Boca Chica. This, however, was not an isolated incident, as the Environmental Protection Agency Region 6 office had also previously informed SpaceX of violations of the Clean Water Act. These violations are a serious matter, as they can delay approvals for future launches and entail civil monetary penalties, further investigations, and even criminal charges.
The violation notices primarily stem from SpaceX’s water deluge system, which is integral to the launch and landing of its Starship spacecraft and Super Heavy rocket. The Harlingen region received complaints alleging that SpaceX was discharging deluge water without authorization from the TCEQ. The investigation found that SpaceX discharged industrial wastewater without a permit on multiple occasions. This raises concerns about how SpaceX obtained approval from the Federal Aviation Administration for its launch operations despite these violations.
The consequences of SpaceX’s actions go beyond regulatory violations. The first test flight of the Starship in April 2023 resulted in an explosion that damaged the launchpad, endangered species’ habitats, and caused a fire in the Boca Chica State Park Land. Environmental groups filed a lawsuit against SpaceX and the FAA, highlighting the detrimental effects of SpaceX’s activities on the local ecosystem. The rushed rebuilding of the launchpad without proper permits further exacerbated the environmental impact.

The levels of mercury disclosed in SpaceX’s permit application exceed water quality criteria by a significant margin, posing a threat to marine life and ecosystem health.
